| Public Policy
The Office of Public Policy is responsible for promoting
TIA's legislative and regulatory agenda on Capitol Hill, with the US
Presidential Administration and in the various state capitals around the
nation.
Public Policy positions are developed through the standing
Legislative Committee, composed of TIA members involved in the political
process with membership in other trade associations and who have a
multi-modal view. Position recommendations are forwarded to the TIA
Board of Director for consideration.

| TIA and OOIDA join to fight fraud.
As the press has been reporting, TIA and the Owner-Operator
Independent Drivers Association (OOIDA) have joined together to promote
legislation to fight fraud in trucking. Leaders of TIA and OOIDA,
at the urging of Representative Peter DeFazio (D-4th/OR),
Chairman of the House Subcommittee on Highways and Transit, sat down
together following our battle over the TRUCC Act fuel surcharge and
margin disclosure legislation. What we found was that there was a
common interest between the organizations to find solutions to shared
problems of marketplace fraud.

CTB Home Study Course
The home study course is offered to help individuals study and
prepare for the exam. This course is an intensive three-month on-line
program that utilizes a textbook and on-line materials to provide a
structured review process. The home study course is offered prior to
each scheduled exam.
The home study course allows participants to work at their own pace
from the convenience of their home while taking advantage of a
structured study format and personalized guidance. During the home study
course, you will receive feedback from the instructor on your strengths
and weaknesses, and tips on how to take and pass the exam.
The home study course is not a substitute for the exam. It is
designed to provide a guided view of the appropriate material that the
exam will cover. Course participants take regular on-line quizzes to
assess their understanding of the material.
There are separate fees for the home study course, textbook, and
exam. (Note: If you plan to use the textbook from previous
participants, be sure to check with TIA to make sure you have the
appropriate editions of the textbook being used.) Currently,
Business, 10th edition, by Pride, Hughes and Kapoor is the
correct textbook.
Please note that book orders must be placed 2
weeks before the start date of the course as they will take 7-10
business days for delivery. If book orders are placed after the 2
week deadline, TIA does not guarantee delivery before the
course start date.
CTB Exam
The exam is a four-hour multiple choice exam covering three sections:
basic business principles applied to brokerage; traffic management and
contracting for transportation services; and legal and regulatory
issues. To become CTB certified, you must pass each of the three
sections. Participants have the option of taking all three sections
together or separately; however, applicants need to be aware that all
three (3) sections of the exam must be passed within 12 months or three
(3) testing cycles of taking the first exam. Applicants may
transfer to the next exam date; however, this will count as one
(1) attempt in the three (3) test cycles. The exam is administered
three times a year.
Exam fee is non-refundable. TIA may in
its sole discretion approve transfer of the exam fee one time to the
next scheduled exam (less the Certification Application Fee) only if (a)
a written request accompanied by an explanation of the basis for the
transfer request satisfactory to TIA, is received by TIA two business
days prior to the exam date, and (b) written approval is given by TIA to
the requestor before the exam for which the transfer is requested.
Exam Results
Exam results are scored on a pass/fail basis. Candidates will receive
their results approximately 3 to 4 weeks following the exam.
(Exam scores will not be given out by phone; all candidates will be
notified of their results via mail.) Candidates who do not pass
section(s) may re-take the failed section(s) during the next scheduled
exam date. Partial pass scores (pass one or two sections only) are valid
for one (1) year or three (3) test cycles which includes the initial
exam. Candidates must pass all
three (3) sections of the exam within 12 months of taking the
first exam.
Eligibility Requirements
A candidate's eligibility to take the exam is determined through an
application process. Applicants must earn at least five (5) CTB
Candidate Eligibility Points to qualify for the examination. Points are
earned through a combination of professional and educational
experience.

| Fuel Surcharge - Broker Regulation
TIA Opposes S. 2910, H.R. 5934, H.R. 5997
(S. 2910, H.R. 5934, H.R. 5977
and H.R. 5997) TIA opposes attempts to re-regulate the industry under
the guise of fuel surcharge relief. Brokers, forwarders and motor
carriers should not be required to reveal their margins as required by
the “Trust in Reliable Understanding of Consumer Costs Act”
(TRUCC Act). In no other industry are businesses required to
disclose their profit margins to vendors or customers. The TRUCC Act
will open new avenues for class actions lawsuits against brokers,
forwarders and carriers. Fuel surcharge legislation is not
necessary as brokers, forwarders and motor carriers are collecting and
passing along fuel surcharges. No one is profiting from fuel
surcharges.
TIA's staff and lobbying firm have been very aggressive on Capitol
Hill voicing our concern over H.R. 5658 and educating Members of
Congress and their staff on what this legislation would do to the

| Commerce-Trade Partnership Against Terrorism (C-TPAT) Update

The quarterly Departmental Advisory
Committee on Commercial Operations of Customs and Border Protection and
Related Homeland Security Functions (COAC) was held recently in
Washington DC. The COAC is an advisory body jointly sponsored by
the US Department of Treasury and the Bureau of Customs and Border
Protection. It is comprised of twenty private sector members who
primarily work in the transportation sector. Members serve in a
volunteer capacity for a two-year term. They are eligible for
re-appointment to a maximum second two-year term.
Among the many agenda items, Bradd
Skinner, Director of the C-TPAT Program for the Customs & Border
Protection Bureau, gave an update on the program. To date, there
have been 8,322 members certified into the C-TPAT Program, including
7,467 validations and 830 re-validations. In addition, some
members have moved from Tier 2 to Tier 3 level of certification.
Also, 531 members have been suspended or removed from the program
because they failed a validation or as the result of a security
incident.
Of the 531 suspended or removed members,
252 were related to the highway carrier industry.
There was also discussion by COAC
members of inclusion of property brokers in the C-TPAT program.
There has been a struggle by Customs staff to recognize, by definition,
3PLs that do not already fit into one of the already approved
modules. Customs staff was asked to have the draft of eligibility
criteria to the C-TPAT sub-committee for presentation at the next COAC
meeting. The next meeting of the COAC is scheduled for August 7,
2008 in Seattle, Washington.

| Brokers Household Goods
The Federal Motor Carrier Safety
Administration (FMCSA) proposed to amend its regulations to require
brokers who arrange transportation of household goods in interstate or
foreign commerce for consumers to comply with additional consumer
protection requirements. This rulemaking is in response to the
Safe, Accountable, Flexible, Efficient Transportation Equity Act: A
Legacy for Users (SAFETEA-LU) and a petition for rulemaking from the
American Moving and Storage Association. TIA submitted comments
opposing this proposed increased government regulation of household

| Carrier Safety Ratings
TIA supports the position that the U.S.
Department of Transportation alone should be responsible for qualifying
and licensing safe motor carriers. Shippers, brokers and forwarders
should not be liable for the safety of carriers that DOT licenses and
allows to operate.
| Transportation Funding
TIA supports a holistic, national,
multi-modal, approach to transportation funding that maintains our
current investment and expands capacity where it is needed. TIA
participates in the National Multi-Modal Transportation Steering
Committee whose mission is to identify a strategy to secure the safety
and efficiency of
America’s
transportation infrastructure, in accordance with the goal of new

| Privatization of Toll Facilities
TIA opposes the privatization of
existing infrastructure.

Endorses ATA Policy on Privatization of Toll Facilities
TIA has endorsed the American Trucking Associations (ATA) policy
on privatization of toll facilities. According to the policy, TIA
opposes the lease or sale of toll roads, bridges or tunnels to private
parties for the purpose of funding highway infrastructure. For more

| TIA Joins Truckers in Opposition to LA/Long Beach Air Plan
TIA has joined the Harbor Truckers for Sustainable Future to oppose
the San Pedro Bay Clean Air Action Plan that was adopted by the Ports of
Los Angeles and Long Beach in November 2006. Under the plan, only
concessionaires that are licensed by the ports operating clean trucks
would be permitted to enter the terminals without having to pay a new

| Unified Carrier Registration Plan and Agreement
SSRS Is Gone. The Single State Registration System
(SSRS) imposed on interstate regulated motor carriers was repealed by
Congress effective at the beginning of 2007. There will be no SSRS
program in future years.
Instead, all interstate motor carriers - regulated, exempt
and private - as well as interstate brokers, freight forwarders and
leasing companies, are subject to fees under a new system, the
Unified Carrier Registration Agreement, or UCRA, enacted by Congress and
administered by states. States will shortly begin to require interstate
carriers and others to register for the UCRA program and to pay the new
fees imposed under this program. To read

| Texas Margin Tax
On Friday, June 15, 2007, TIA celebrated a victory as Texas Governor
Rick Perry (R) signed into law HB 3928, the technical corrections bill
to the new state franchise tax (margin tax). The Texas Margin Tax
Coalition, which was spearheaded by members of TIA and Texas Courier and
Logistics Association, was extremely successful in establishing
legislative intent and new clarifications that should reduce taxes and
protect our industry's concern with flow through deductions and

| Defense Transportation Coordinator Initiative (DTCI)
Menlo Worldwide Government Services, LLC of San Mateo, CA, has been
awarded a fixed price logistics contract by the U.S. Department of
Defense, which is valued at $525 million for the base period of the
contract. If all option periods are executed, the value of the contract
could exceed $1.6 billion.
Menlo Worldwide Government Services, LLC is the third-party logistics
subsidiary of Con-Way Inc. and will serve as the prime contractor for
the Defense Transportation Coordinator Initiative (DTCI). As the DTCI
awardee, Menlo Worldwide Government Services, LLC will provide shipment
planning and transportation management and execution for the defense

| New Fuel Surcharge Rule Takes Effect For DOD Shipments on
July 29
The Department of Defense's (DOD) interim final rule implementing a
provision the 2008 Defense Acquisition Act became effective July 29.
This rule requires pass through of any government paid fuel surcharge to
the person actually purchasing the fuel. This rule is a required
Federal Acquisition Regulation (FAR) contract clause which must be
included in all DOD solicitations and contracts for carriage in which a
motor carrier, broker or freight forwarder which will provide or arrange
for truck transportation services and that provide for a "fuel related
adjustment."
The much longer and more complicated language in the draft circulated
last spring by Surface Deployment and Distribution Command (SDDC) to TIA
for comment prior to publication would have required disclosure of the
amount of the surcharge on every shipment, prescribed payment terms and
imposed complex allocation and accounting on loads carried by more than
one carrier.
The TIA government freight committee put together a letter that TIA sent
to SDDC objecting to the draft language as unworkable and unsupported by
the statute.
This is an important accomplishment for TIA, due in large part to the
strong working relationship the committee and TIA staff has forged with
Jim Gilmore and his colleagues at SDDC.
DOD is soliciting public comment, to be submitted on or before September
28, 2009, but in the meantime the rule became effective on July 29,
2009.
The text of the rule is quite short, and paraphrases the language of the
statute, as
follows:
(a) The Contractor shall pass through any motor carrier fuel-related
surcharge adjustments to the person, corporation, or entity that
directly bears the cost of fuel for shipment(s) transported under this
contract.
(b) The Contractor shall insert the substance of this clause,
including this paragraph (b), in all subcontracts with motor carriers,
brokers, or freight forwarders.

The Hilton Tucson El Conquistador Golf & Tennis Resort is the
largest and most popular Tucson, Arizona golf resort and ranks as one of

TIA has secured the amazing Cañada course for the 2010 TIA
Foundation Golf Outing on Wednesday, April 7, 2010. The 18-hole
Cañada course is a 6,713-yard par 72 with a rating of 72.2 and a
slope of 140. The natural terrain comes into play as fairways wind
through ravines and arroyos. The challenge of this course is the club
selection. There is a lot of variety on Cañada – with
considerable mounding, doglegs and elevation changes from the tee to the
green. There are many birdie opportunities on the par 4’s, but the
risk may outweigh the reward for some golfers.

| The Third Quarter TIA 3PL Market Report Shows That Smaller
3PLs, Brokers Gain Volume, Sales
Profit margins got tighter in 3Q as recession lingers,
report finds smaller logistics operators and freight brokers
outperformed their larger counterparts in the third quarter, but a
less-than-robust recovery is squeezing profit margins at all 3PLs, said
the Transportation Intermediaries Association.
TIA’s latest 3PL Market Report shows intermediaries with less
than $3 million in annual revenue increased sales and shipment volume
over the second quarter, while larger logistics operators reported flat
of slightly falling sales and volume.
The average profit margin at all 3PLs surveyed by TIA dropped 1
percent to 17 percent in the quarter, indicating a recovery still stuck
in neutral or in very low gear.
The larger 3PLs — those with $3 million to $10 million and more
than $10 million in revenue — also reported a "modest contraction"
in truckload billings.
Rate discounting also played a role. "Downward pressure is being
placed on prices and having a relatively larger impact on total TL
dollars billed," the TIA said.
Truckload shipments accounted for 80 percent or more of the revenue
generated by the 3PLs surveyed. Rail represented the next largest source
of revenue, particularly for larger operators. Use of rail increased as
shippers looked for "low cost shipping alternatives," the association
said.
The number of LTL shipments rose from the second quarter, although
total billings declined 5.8 percent. That could indicate a higher number
of smaller LTL shipments, reducing total dollars billed, the TIA
said.
"While total dollars billed, total TL dollars billed and total LTL
dollars billed all experienced at least a 5 percent decline in Third
Quarter 2009 when compared to Third Quarter 2008, this decline was not
necessarily matched by significantly lower volumes," TIA said.
"For example, LTL dollars billed was down over 5 percent but average
volume per company was almost unchanged."
The average profit margin for those 3PLs tracked by the report since
its inception actually rose year-over-year, climbing half a percentage
point to 17.5 percent.
The publication is based on a monthly survey of TIA members who
submit real operating data, and answer questions on business conditions
affecting the 3PL industry. TIA’s efforts are providing a truly
comprehensive report on the trends and practices of the 3PL industry. To

The regulations of the FMCSA (49 USC 13304) require that each broker
must list process agents in each state in which they have an office and
in which they write contracts. The process agent serves as the carrier's

any legal actions that may be filed against the carrier in the
state for interstate shipments that are transport to, from or via that

| FEDERAL MARITIME COMMISSION VOTES TO PUBLISH
PROPOSED RULE EXEMPTING NVOCCs FROM TARIFF PUBLICATION
The Federal Maritime Commission has voted 3-1 to grant a
petition by the National Customs Brokers and Forwarders Association of
American (NCBFAA), supported by the Transportation Intermediaries
Association and other major shipper and NVOCC organizations, for a
voluntary exemption from the current tariff publication
requirements. The exemption was first requested by the
International Federation of Freight Forwarders Associations (FIATA) in
1991, when the Commission deadlocked 2-2 on whether to grant it.
The NCBFAA has two filed petitions since then, both after ocean shipping
was partially deregulated in 1998.

It would be confined to rates and terms quoted to customers, and a
written record of the agreed rates and terms would have to be maintained
for five years. NVOCCs would continue to publish standard rules
tariffs containing terms and conditions applicable to all shipments, and
make them available free of charge.
It may take some time for the FMC staff to develop a proposed rule
consistent with the action taken by the Commission. It will be
published in the Federal Register for public comment, and a final
rule will then be developed based upon those comments.
The Commission will be asking for public comment on a proposed
“safe harbor” form of rate quotation record to be used by
NVOCCs in lieu of tariff publication. The exemption requested by the
NCBFAA was limited to licensed NVOCCs, i.e., those with an office in the
United States, but the Commission will be open to considering public
comments in support of extending the exemption to foreign NVOCCs
registered with the FMC (but not required to be licensed) before
publishing the final rule.
The commissioners engaged in a lively debate over the proposed
exemption. It was vigorously opposed by Commissioner Brennan, who
argued that it exceeded the Commission’s legal authority and would
impair its ability to protect consumers from unscrupulous NVOCCs,
especially in the household goods industry. He demanded a public
hearing with testimony from industry witnesses before taking any
action.
The other commissioners pointed out that there was a very full record
of public comments supporting the petition, with the only opposition
coming from the tariff publication companies. FMC staff economists
testified that elimination of the publication requirement would reduce
costs, enhance efficiency and increase competition, without any
offsetting detriment to the public interest. Commissioner Dye
pointed out that 3200 businesses would qualify for the exemption, and
that they service thousands of exporters who rely heavily on them to
succeed. Chairman Lidinsky noted that shippers would be protected
by the requirement to maintain a written record of the agreed rates for
audit or enforcement purposed, if necessary. Commissioner Khouri,
the newest member of the Commission, stated that the Ocean Shipping
Reform Act of 1998 had liberalized the Commission’s exemption
authority, and that the shippers whom the statute is meant to protect
actively supported the exemption.

Uniform Carrier Registration (UCR) Fees
Due
The Federal Motor Carrier Safety
Administration published Uniform Carrier Registration
(UCR) fees for 2010 in the Federal Register on April 27.
The new fee structure increases fees substantially. Brokers and
forwarders will pay the $76. annual rate which is the same fee as
the smallest truck fleets. TIA members can go to the www.ucr.in.gov link, locate your base
state and pay the appropriate fee online. 41 states are
participating in the on-line UCR system.
C-TPAT
- Congressman Bill Owens Takes Lead
Congressman Bill Owens, (D-23-NY, has
taken the lead for TIA on the C-TPAT issue, by writting a letter on our
behalf to United States Customs and Border Protection, Commissioner
Bersin, referencing the Customs-Trade Partnership Against Terrorism
(C-TPAT) elgilibility criteria for Third Party Logistics Providers
(3PLs) that went into effect in January 2009. The proposed
criteria, appears to eliminate all 3PLs that do not operate their own

TIA Education & Research
One of our goals at TIA is to both educate and produce research
necessary to help our members meet the challenges of the competitive
marketplace. Our education programs have been developed to assist
all levels of expertise in the industry. Our online courses range

truly comprehensive report on the trends and practices of the 3PL
industry, providing a representative understanding of what is happening
within this business sector. Participants are divided into five
revenue size categories. The report includes number of shipments
by mode, total billing, gross margins and forecasts, based on shipper
data to provide expectations of the near term volume of business, either
positive or negative.

TIA 3PL Samaritan Award
April 23, 2010
Dear TIA Members and
Associates:
The Transportation
Intermediaries Association (TIA) is pleased to announce a new award
through which the Association will recognize a member for exceptional
service and assistance to others in need. The recognized service
or assistance can take any form from volunteering logistical support to
providing manpower, resources, or financial support to others in need,
sponsoring sporting events, providing scholarships, hiring disabled
people, etc. The purpose of the award is to recognize the good
works in which the 3PL industry is engaged by highlighting a specific
3PL Samaritan effort each year.
Eligibility:
any TIA Member or Associate or their employees.
Process: A
TIA member can nominate themselves, another TIA member company,
individuals, or organizations by August 1, 2010. A committee of
TIA members will then review the nominations and make a recommendation
to the TIA Foundation Board of Directors. The TIA Foundation
Board, during its summer meeting, will make the final decision on the
recipient. The nomination should be in the form of a letter
outlining the charitable activity providing sufficient detail for the
committee to select one award recipient.
Award: The
TIA 3PL Samaritan Award will be presented at the uDrove Humanitarian
Bowl on December 18 in Boise, Idaho as part of the bowl’s
overall recognition of the transportation industry’s humanitarian
efforts, which also includes the Truckload Carrier Association’s
presentation of their Highway Angel Award.
Recognition:
The TIA 3PL Samaritan recipient will be recognized with a trophy
presented during the Humanitarian Bowl by TIA’s Chairman and
President. The recipient and the runners-up will be featured in a
front page article in the December TIA Logistics Journal.
The recipient(s) will be compensated for travel to Boise and their hotel
stay while in Boise. As an added bonus, TIA will launch a TIA
Foundation Charity Fun Run at the 2011 TIA Convention, and the TIA 3PL
Samaritan Award recipient will be able to designate their charity as the
recipient of funds raised by the fun run. All nominees and their
efforts will be recognized on the TIA website.
This is a very exciting
opportunity to showcase your good deeds. Please send your letter

| OASIS Capital No Longer Issuing Bonds
The Federal Motor Carriers Safety
Administration (FMCSA) has officially inactivated OASIS privileges as a
filer for property broker's trust funds. OASIS' failure to comply with
the attached letter, dated May 3, will result in FMCSA revoking OASIS
privileges to submit trust funds on behalf of carriers permanently; and
will terminate the registration of brokers that currently have OASIS as
their trustee. See letters from the FMCSA below.
