The Transportation Intermediaries Association (TIA) is the professional
organization of the $114 billion third party logistics industry. TIA is
the only organization exclusively representing transportation
intermediaries of all disciplines doing business in domestic and
international commerce. TIA is the voice of transportation
intermediaries to shippers, carriers, government officials, and
international organizations. TIA is the United States member of the
International Federation of Freight Forwarder Associations FIATA.
TIA conducts an annual convention and trade show; an annual marketing
conference with leading shippers and carriers; and provides education,
research, and services to help our members succeed.

Fraud Alert - November 28, 2007
TIA was alerted this week by two individuals who were contacted by a company calling
itself DBS Logistics, LLC, using a Deltona, FL, address claiming to be a TIA and
P3 member.
This alleged company has never been a TIA or P3 member. The company name DBS Logistics
LLC and address listed belong to a legitimate motor carrier who knew nothing about
this Web site. He is currently talking to local authorities about this matter. This
Alert is not directed in any way toward the real DBS Logistics LLC, who appears
to be the victim of corporate identity theft. In our investigation, we have found
that the imposter's Web site is hosted in Egypt. To read this article in its entirety,

UPDATED FRAUD ALERT!
WTA Logistics, Not a Member
TIA members and the industry should be on the look-out for a company named, WTA
Logistics, Inc., located in Stuart, FL. According to the company's Web site www.wtalogistics.com,
they are a member of TIA and P³. WTA Logistics, Inc., is NOT a member of either
organization. TIA is currently pursuing legal action against this company regarding
their false membership claims and to ascertain their legitimacy as a company. All
TIA members are listed on the TIA Web site under "Find a Member."
New Fraudulent Letters Sent to DOT Contractors and Potential Contractors
TIA members are being warned about new fradulent letters that are being sent to
U.S. Department of Transportation (DOT) contractors and potential contractors.
The letters request that current or potential contractors register in the U.S. Department
of Defense (DoD) Central Contractor Registration System (CCR). Please be aware that
DOT does not require any confidental information to be submitted to verify CCR registration
and that all companies should verify personally that they are sending information
to an authorized DOT official before submitting confidential company information.
The letters have been dated December 19, 2005, and is signed by "Frank M. Orell;"
February 8, 2006, and is signed by "Randy Cohen;" April 27, 2006, and July 28, 2006,
and is signed by "Dan Jacobs," and November 8, 2006, and is signed by "Lisa Johnson"
as the Senior Procurement Officer. Please DO NOT complete the requested CCR worksheet
that is attached to the letter and DO NOT release any information to the facsimile
number cited in the letter.
The CCR is a legitimate government system. However, to register, contractors should
go directly through the CCR Web site and not through a third party. There is no
requirement to send information directly to DOT. For information on how to register
in the CCR, please visit their Web site at www.ccr.gov.
The point of contact concerning these fraudulent letters is the Department of Transportation
Office of the Inspector General Hotline at (800)424-9071.
Fraud Alert!
TIA was alerted yesterday to two individuals who were contacted by a company called
USA Cargo using a San Ramon, CA address claiming to be a TIA Member. This
company has never been a TIA Member and the address listed is bogus. Our attorneys
investigated the website and found it to be hosted in Hong Kong.

Fair and Balanced Contract Brings Industry-Leading Benefits and Support To Both Parties

Alexandria, Virginia - The Transportation Intermediaries Association
(TIA), the leading trade association of third party logistics companies,
has unveiled a Model Broker-Carrier Contract to promote best practices
between brokers and carriers. The Model Contract is available on TIA's
website (www.tianet.org) beginning today.
After previously helping to successfully create and execute the NITL/TIA
Shipper-3PL Contract, which became an industry standard contract, TIA
formed a committee comprised of an equal number of asset-based and
non-asset-based TIA members to develop the TIA Model Broker-Carrier
Contract.
"Our sole objective for the TIA Model Broker-Carrier Contract was to
create a fair and balanced template contract that would raise the
standard and suit the best interests of both brokers and carriers," said
Robert Voltmann, TIA's president and CEO. "Carriers and brokers can both
safely sign the TIA Model Broker-Carrier Contract without fear of hidden
provisions. We believe, therefore, that the TIA Model Broker-Carrier
Contract will make both parties more efficient."
"As president of a carrier, having a standardized contract will
create efficiencies and save me a great deal of time," said Rick Staller,
President of Bee Trucking, Inc. and Chairman of the TIA Motor Carrier
Conference. "This contract covers two of the big issues for carriers: it
obligates brokers to pay even if they don't collect from the shipper and
allows for recourse if the broker doesn't pay within an agreed time
frame. As such, the TIA Model Broker-Carrier Contract offers better
protection to the carrier than any previous contract."
The TIA a Model Broker-Carrier Contract provides these key benefits for both carriers and brokers:
- Broker Must Pay: Provides for carrier to receive payment
from broker, regardless if broker collects payment from its
customer.
- Recourse to the Shipper: Provides the carrier with
recourse to the shipper for payment should the broker not pay the
carrier.
- Recognition: Provides carriers with a recognized document for working with brokers.
- Ease of Use: The contract is easily accessible on the TIA
website in both an interactive PDF format and a text format.
- Provides for Payment to Performing Carriers: Provides for
a prohibition against un-authorized re-brokering of the load. The
model also provides for payment directly to the performing carrier
should the broker find out that the load has been re-brokered
without permission and before payment has been made.
- Dispute Resolution: Provides for arbitrating disputes
with the choice of arbitration forum open to the parties to
negotiate.
"This model contract was developed by an active committee of carriers
and brokers, which has helped to make it a fair and balanced," said Alec
Gizzi, the Chair of the Broker-Carrier Contract Committee and President
of JBS Logistics, Inc.
TIA is the first organization to provide a Model Broker-Carrier
Contract for the industry, spending more than a year analyzing the best
practices and contracts throughout the industry.
"We wanted this contract to equally represent both parties, so we
elicited feedback from every major industry organization. We have
incorporated many of the suggestions we received, such as the Recourse
and Broker Must Pay clauses," said Voltmann. "We are confident that this
contract will become the industry standard."
The TIA will continue to assess and develop new opportunities for
improvement within the carrier and broker industries, working with other
organizations to establish best practices.
